    I would be too, except the general replies are off target - the real issue is the child's entitlement to live in a property irrespective of which of their parents owns it/lives in it with them. (Charlie will know this answer and for obvious reasons is creating trouble among different posters for obvious reasons).

    You dont have to be married to have protection from this Act.

    That is not the case outside of Scotland. Common law spouse does not exist.
