I would be too, except the general replies are off target - the real issue is the child's entitlement to live in a property irrespective of which of their parents owns it/lives in it with them. She may have a case under the Married Womans Protection Act. Also if it went to Court, the Court would take the intrests of the child into account, and as mad as it may seem give the home to her!
You dont have to be married to have protection from this Act.
That is not the case outside of Scotland. Common law spouse does not exist.0
