in Credit cards
Hi all. im asking on behalf of my mother.
The situation is as follows:
My mother is divorced from her hubby, he had credit cards in his name. My mum WAS NOT a cardholder.
He is now threatening to take my mum to court for her to pay back half of them.
She has asked for statements so she can see what the money was spent on. He refuses to produce any.
Is she liable for half the debt? TIA

Nope, he is 100% Liable, lol
Poor bloke
Now if either one was asking for a fraction of the others money, it would be a completely different story!Official SOS Club number 014 - Dry until 29.11.090 -
Thanks Rose,
Just dont understand the last bit, can you elaborate?
Glad he's liable cos the a**e spent all the money on the bint he was seeing behind my mums back for 2 years!0 -
If he asks for a fraction of her money (i,e savings) or if she asks for a fraction for his money then in some situations (depending on the court and reasons for the divorce), either one will have to pay up. Not always the case as every divorce is different and so are circumstances.Official SOS Club number 014 - Dry until 29.11.090

ahhh right i see. They divorced 2 years ago. It was settled then that they would sell the house and any profit would be split 50/50.
Nothing else regards money was discussed in the divorce, so i presume as its been 2 yrs he cannot now ask for more money. The house is still not sold though so will that make a difference?0 -
nope, just the arrangements made at the divorce so if thats what they agreed, thats all he will get!
Dont worry about the credit card, its in his sole name so hes 100% liable, even if she was a cardholder he would STILL be 100% liable, lolOfficial SOS Club number 014 - Dry until 29.11.090 -
