Cheque bounced due to bank error advice needed

    This woman asks for help and advice concerning a problem with a bank error involving a cheque and the majority of the posters in this thread have not been helpful at all!

    I use cheques myself if required and I'm due to give one to a friend tomorrow as my share of payment for a stay in a apartment in London over this weekend as it's less hassle that way.

    My initial reason for posting was due to concerns that aside from losing my venue, with the cheque was a signed contract the terms of which meant I was in breach of the contract by not paying part of the facility fee on time but that I was still liable for the cancellation fees. This meant my venue could have refused to host my wedding and I would have still had to have paid 3/4 of the fee, as per the contract. This situation would have left me severely out of pocket and with no venue.

    My question was, did anyone know what would the bank have been liable for if that happened?

    The venue have accepted the transfer, they do not normally accept transfers from clients. I don't know why.

    I still have to get a new contract from the venue, as I am in breach of the current one, which is an inconvenience for both us and the venue.

    As a previous poster has stated, the bank may have been liable for any financial loss, but it would be tricky to work out how liable as the situation is complicated. The terms and conditions of the account opened may cover financial loss due to bank error, but to be honest I'm not sure. I would imagine that if it had went as far as a complaint the bank would have offered goodwill compensation, how much would depend on the specifics.

    It is all a bit complicated and I would be happy that you're not having to go down a lengthy complaint route due to loosing the venue.

    I would say it is worth escalating an official complaint about the whole situation anyway (even though it is resolved), just to highlight your disappointment in the service. You may get a wee bit of money for poor customer service as goodwill, or a letter of apology.
    Anything I post is my opinion, so from time to time I may be wrong. I try to provide answers based in fact, however I don't know everything, so (like all posters on MSE), take what I say with a pinch of salt.

    1989 or 2009
    Well, in 1989, mandates were held in the Branch and effective from the date signed. Any new joint account had a mandate, and we also held a specimen signature card for any manual check. That's progress for you, and the improved customer service that we hear about.
    As for cheques, the clearing time is exactly as it was in 1989, despite considerable advances in technology, but the delay benefits Banks rather than customers.

    Update:
    I am still waiting for the bank to come back to me concerning this.
    I chased them up today, to see how much longer it was going to take for them to check that they set up the account incorrectly. Apparently they have sent us a letter to ask us to fill in our signature mandates again. They appear to have 'misplaced' the second set of mandates we filled in (I will mention here that we went to separate branches to sign the mandates too).
    They are really impressing us with their competence!
