Staying on

Okay, this is a hypothetical situation...

- My tenancy is due to end on June 3rd

- I am buying a house, which I can't get the keys to until June 10th

- The landlord will not agree to a Statutory Periodic Tenancy (is this the right terminology?) as he has other tenants lined up to move in on June 6th.

What legal powers do the letting agents/ landlord have to remove me from the property on June 3rd when my tenancy ends?

    I tried to sign up to landlord zone, but I wasn't asked for a Username and I couldn't sign in without a Username :confused:

    Unless your LL has served you with 2 months notice, then the tenancy will wutomatically go onto a rolling monthly tenancy. Check your paperwork, he may have served notice at the start of your tenancy. If not he can't evict you just like that, he has to give you 2 months notice, you have yo give him one months notice.

    I'm pretty sure they can't just chuck you and your stuff out on the street and change the locks.. they have to go through official channels to evict you. However, I suspect they would then have grounds to claim damages from you because their new tenants can't move in on the agreed date. Also, what will happen to the new tenants? Would you expect them to go homeless for 4 (or more) days through no fault of their own?

    Your LL doesn't know the rules. The only way to evict you without your agreement is to get a court order. If you fail to move at the end of the fixed term and the landlord has already served a correct section 21 notice requiring the property back, the landlord can go to court and get the judge to pass a court order requiring you to leave. If you don't leave at that point the landlord can go back to court and get baliffs appointed to remove you.

    All of which is going to take longer than a few days.

    You need to give notice as to when you are leaving unless you are leaving at the end of the fixed term. You need to give notice to end on a rent day, so give notice by 3 June that you will be leaving by 3 July. Unfortunately you will end up paying rent for 4/6 to 3/7.
