OK - so my husbands car has been clamped.... parking control management in operation on our private road which I accept - we come home late last night our allocated space taken, all visitor spaces full, no option but to park where we shouldn't, 5am this morning they came.... now I phone my landlord just now and he is willing to come with bolt cutters to cut if off - where would this leave me and my hubby if he was to do this???? he said we have been good tenants and doesen't want this to effect us!!
Are we liable if he cuts the clamp off??

Just get it cut - At very worst you would be liable for the cost of a new padlock and the chances of them pursuing you through the courts for that are somewhat minimal.
If the landlord is on your side, there is absolutely no chance of them being able to sustain a charge for anything at all.
Then have a read through here about the actions and abuses of private clampers and discuss the issue with your landlord - does he really want these parasites working his property & putting him at risk of being a co-defendant in any court action that might result?
