HSBC bank reclaim - refused claim..what next?

So I used letter one template and sent it to HSBC asking for a list of charges from last 6 years with a £10 cheque for the information. They said they 'destroyed' the cheque and gave a list of charges from the last 6 years, a very very short list and information on certain fees that I 'agreed' to pay like monthly fees which is not listed. They said as the court case is on hold the request will be put on hold with no mention of the financial hardship clause stating they have to look at the case if I qualify. Where do I go from here? Another letter saying I want to be tested for financial hardship? Is there anyway of getting back the fees I 'agreed' to pay like the monthly ones?

Have you got priority debt arrears(mortgage/rent, council tax utilities)?0 -
got an overdraft which is at it's limit, on jobseekers allowance joint claim with my partner, council covering most, but not all of our rent, got water and electric bills to pay ontop.0

Most banks are looking at financial hardship in terms of priority debt arrears and furthermore household income. really? ouch. well they are charging a monthly fee which is coming out our benefit money! just doesn't seem fair. also sent letter one to lloydstsb but no reply yet, got 1,000 loan and monthly charges this year alone totalling in the £100's, same situation on the hardship would it be the same case there? denied?0
