Reclaiming from Capital One - help please!!

Used the charge and interest calculator from this site, sent my letter off claiming £330 for charges and £90 interest.

I received a letter back from Capital One saying they lowered their charges following the OFT case in September 06 and therefore would offer me the difference between the £12 and the £20 charge i incurred. Their offer worked out at £160 for charges and an offer of interest of a measly £10.

Seeing as though all my charges were incurred before they lowered their charge from £20 to £12 am i entitled to claim the full amount. Obviously i dont want to accept their pathetic offer.

Can anyone advise me? Thanks

    You don't have to accept that offer, it's up to you.

    If you are determined not to, I would send off the second letter from martin's guide saying no, requesting the full amount, and thretening court action.

    If they still say no, you can go to the FOS, or take them to court.

    They do not know what they are talking about. If you google OFT842 that is the report into credit card charges. I think point 1.14 or 1.18 of the report states that ONLY A COURT can decide a fair amount.

    Hi I've had similar experience with Nat West who offered difference between £20 & £12 which I rejected. Sent off ano letter that if they didn't improve their offer then I would head to the Courts. One week later improved offer arrived and was duly accepted. Sorted!

    I claimed from Capital One and they sent me exactly the same letter. I was claiming £468 and £110 interest - they offered me £72 twice. I took it to the FOS and got a letter from them yesterday offering me the full amount.

    Push it all the way and get the full amount.

    I claimed from Capital One - £1307 inc interest and court fee - they offered 232 in first letter plus 20 interest - I sent second letter they said offer was final response. Applied through MCOL and within a couple of weeks got full refund from Capital One which has almost cleared my balance. Take them all the way!!! Good Luck!!
