Reclaiming incurred intrest

Hi all

to cut a long story short i have been successful in overturning a default notice placed on my credit record by orange, the have eccepted it was unfounded and are in the process of changing the default notice to unfounded.

However it was nearly two years ago they wrongly served this default noice on my record in which time i stopped being able to get new 0% credit cards to transfer my balance when my original 0%rate was up, so as a result have accoured nearly £2000 of intrest payments.

Can i claim this back from orange as they have accepted this was an unfounded default?

    Dare I say this, but you might want to ask orange for compensation. There is case law on defaults which is Durkin v. DSG Retail Limited & HFC Bank plc.(March 2008).

    You should be able to get £8000 just for the cheek of them wrongly defaulting you.

    Because of legal fees though, it may be wise to keep things in the small claims court. I understand that's just £7500 in England.

    Good luck. Let us know how you get on. It should be relatively straightforward.

    £5000 in England in county court. Where does the £8000.00 come from?

    I stand corrected. It's a shame it's only £5000. The small claims court is much easier to deal with.

    £8000 comes from the amount I was awarded in Aberdeen for simple injury to credit. It's a lot of hassle outside the small claims court though.

    I understand the case "Durkin v DSG & HFC" is being used to quickly remove wrongful defaults. People doing this should also claim an "easy £5000" though.
