halifax bank charges claim

hi all i have a claim in with halifax for some time now totalling £1365 i got a letter from them offerring me £440 i rang them to negotiate but they said it was only deal on the table so i said i couldnt accept and will continue with the claim whats my next move can i insist on bein paid by cheque as they were paying the £440 into my account if i accepted any thoughts guys thanks p

    Thats actually a good question, my other half is trying to claim from Halifax, do they have to pay into his account? although I think(think!!)they may have closed his account, any help would be great x

    I don't think you should reject an offer of payment however on the negotiation side I think you need to look at priority debt arrears ie mortgage/rent, utilities, council tax against the offer on the table. Furthermore, if it is paid into the account and it is overdrawn then how much money is left over for priority debt arrears.
    For example, if the account is over the limit by £200 then the offer in real terms is £240. If the priority debt arrears are £440 then they need to either (a) up the offer by £200 or send cheques payable to those priority debt providers. Does that make sense?
    The offer is not a full and final settlement of the claim so whatever is not paid through Financial Hardship will be paid once the conclusion of the test case is completed.

    It will only be paid into the account which the charges were taken from, unless that account is now closed.
