Of course if the agreement did come to light at any stage and contained all the prescribed T&C's this would give them the ACE. So the 50% offer may then have looked a good offer. It is a gamble I personally would take. I would sit tight and wait for the agreement. If it did come and all looked okay then I would start negotiating, rather than it go to court. I would hope that I could settle at a f&f of about 25-35%. I would need to make sure I had the ready cash available, as I would not expect them to reduce the amount so much and for me to still pay a monthly amount.
If no agreement was forthcoming or it looked like it was unenforceable I would leave the ball in their court. In my mind would be that they would need to claim against me in my local court, and the worst case scenario would be that the judge would award in their favour and give me 28 days to pay if I didn't want a CCJ or would let me pay a monthly amount, subject to earnings, but would slap a CCJ on my Credit File for 6 years.
The important thing for me would be to do lots of reading on the net and stay calm.

Yes mine have all been postal orders rather than cheques for exactly that reason.
