cab said because i have no income bar my wifes and that doesnt even pay the mortgage they cant see any other way exept bankruptcy due to me having over £25k debts, my hose is worth £145k and i have a mortgage of £156k and secured loan of £7k
Asked to be referred to a debt worker (cab) rather than a general adviser has they have more experience in dealing in your situation. I do not have alot of experience in advising on going bankrupsy, but there is a bankrupsy board on here where they have numerous experts on it who will be able to give you a more personal slant as they have been there and got the t-shirt, good luck!

the abbey wont help atall when i thought they would?
my mortgage is just in my name and i dont work atall and finding a job is near on impossible
I'm sorry to hear that. :( Mine is with Northern Rock, but once my payment holiday allowance runs out they won't help me any further. I have insurance, but like the mortgage, it's in my name only, so, frustratingly, we'd actually be better off if I were made redundant as well!

Jobhunting is indeed near on impossible as you say- OH has been looking since last October, not just for IT work, but retail, cleaning, anything and still no joy, and I've been looking for a second job too and getting nowhere either.:(
Owing to financial constraints, the light at the end of the tunnel has been switched off until further notice. :(

Are you sure as this is something that the CAB does not like to advice people as it costs to go bankrupt aswell as other things. If you do get your house repossessed, you will be still responsible for any debt leftover which could be substantial. You may not be able to pay the mortgage but the quicker you take action, the less mess you will be in later.

Not if he goes bankrupt; it's wiped out then.

OP, I suggest you post on the Bankruptcy Board to clarify your options. From what you've said, the CAB may well be right.

It does not always get wiped out according to a debt worker that I work with, I did not quite understand what she was talking about, but they are a few cases where it is not.

sorry to hear your situation, but thats the benefits agency for you, i have no idea what CAB will say, but it seems to me that you have 2 options, 1 go to CAB and ask their advice, or 2. ask you wife to quit her job and sign on with the job centre aswell and also get her to put in for the morgage to be paid, which will mean you WILL get your mortgage paid i'm 98% sure of it. I know it sounds stupid, asking your wife to quit her job and sign on. But it could be thats all thats standing in the way of getting it paid for, of course you should ask the jobcentre before she quits or the other benefits agency if you will be better off, or even ask the cab.
Applying for Bankruptcy I believe is not the way to go, worst thing you could do. means you will be put on a Blacklist.

If his wife quits her job voluntarily there will be sanctions on the JSA for up to 26 weeks and they will be even worse off, so I personally think that would not be a very good idea.

ok maybe i was wrong about the wife quiting her job, but how about if she where to ask her employers to reduce her hours of work to less than 16hrs, she would then be classed as part-time working, 25hours i'm sure they class as full-time.
under 16hrs is part time and anything over 16hrs 1min+ is full time.
And didnt the government bring out something about repossession this year and the telling mortgage lenders not to reposses instead extend it due to all the job losses in this new recession think there was something on the news about it.
And the problem with bankruptcy i was referring to would make it hard to get re-mortgaged or transfer to another cheaper lender sometime in the future or applying for a credit card.
what about all these adverts on tv about how they can reduce your debt by getting the company to remove upto 15,000 and you only paying of the rest of it, or whatever they said. Dont watch much tv now.
