help required please... (urgent)

this situation is regarding my mother in law and what would seem a solicitor that isnt either very good or not really interested. I was wondering what the letter of the law in this circumstance would be.
right here goes the mother in law got a CC in her name as main account holder then later on she got married to a chap and then added him as a second card holder. later on things went wrong they split up, he then completely disappeared other than by an email addy which he would come on and annoy her.

The divorce went thru email notification in the end because no on can track him down. anyway soon as they split up she rang the cc company and asked them to cancel the second additional card as he was not with her any more, the cc company point blank refused and said they need his agreement she could not just cancel the second card herself even though she was the main account holder. she even asked to cancel the whole account they also refused this even though account was clean and clear.
she tried this call on two separate times and got the same answer.
so unfortunately the chap rang her up next day after second call to company and then asked him not to use said card he come back with no of course not. Then next bill time or so in comes a bill for £6000 with the credit card company demanding the money.

At the start they where both working full-time in the end he was medically retired and she was declared by the doctor unfit for work by a long term illness that had come back severely and would mean she would not work for the foreseeable future.

Now this has been left in the hands of the solictor for the last 6 months with what seems to be going nowhere. the mother in law has just income support and is just about coping to pay rent and bills barely. the cc company is now sent a letter thru to her saying they will be taking her to court within 7 days etc she has phoned them explaining the solictor dealing with it is on holiday and the cc company have agreed to hold off till solictor is back.

she is worried sick about going to court and is getting more worse with her illness each day mainly i believe because of this.

could anyone with clear law information advise please as i believe the credit card company themselves have been not obeying the rules themselves as you should be able to cancel a second card if you where the main account and are legally responsible for the lot or failing that you should have been able to cancel the whole account before any of this happened.

any help appreciated

    could she have reported it stolen? Then they would have had to cancel it.Shame she didnt do that.

    Did she ever get anything in writing from the cc company to say that they wouldn't cancel the card? Seems odd to me that wouldn't let her do this - or at least sign herself out of it.
    Reason for edit? Can spell, can't type!
  • as the main card holder, u should be able to cancel ur ex partners card straightway... something seems fishy here, contact ur local trading standards and the FOS .... i would

    exactly, for instance the OH could have got a fem friend to ring and pretend to be you and ask for a new card to be sent out! A host of things could happen but either way as the main cardholder you are ultimately responsible for any debt unfortunately.

    Unless the OH has fraudulently obtained credit then you will have to stump up or refuse and have adverse credit for 6yrs. Bummer but other than the legal route not much left.

    I simply don't believe what the OP is saying about the bank refusing to cancel the additional card use. Utter nonsense.

    The OP will have to get the facts correct. Start by posting the name of the bank and who you've spoken to there.

    Hey cmmon though, some banks really are inept and it would be better to give the OP the benefit of the doubt for the time being.... I'm inclined to think something is amiss but i'm not judgemental and why write such a long post for no reason?

    Only logical reason I can see is maybe this is a front and they colluded or maybe spent the funds and passing the blame...
