Insurance !!!! up costing me for their error

Hi I'm hoping someone can help. This forum was suggested by a friend and I guess this (or the debt collection section) is the appropriate as its covered by both. However the collection service (wescots) have been exceptionally easy to deal with and have passed their dispute back to the insurance company. This gets me to the crux of the matter so please bear with me whislt I briefly outline the scenario.

On 29.8.2009 I took out an insurance policy for a white car I had with express insurance. All was fine until in December 2008 I changed to a smaller blue car.

At this point I rang up Express and requested my policy be changed to the correct car and that I had moved address.

Flash forward to, today and I received a letter from wescot stating they assumed this was my address, though insurers knew this (wescot received address apparently from Experion not insurer, but this does means my nice credit reference is now screwed temporarily) which it is and that I owe £272 for the white car insurance which hasn't been paid.

Obviously my first point of call was to ring the insurers up as I instantly panicked I hadn't had cover for the blue car, however it turns out I do (phew).

So the long and short of it is, someone their end set up a new policy (3.12.08 as I've got the new details on letter stamped paper and policy) instead of altering my existing one (despite all details on the new one showing the start date and end date of (Aug 08 and 09 respectively).

That the "new policy" which shouldn't have been set up has used the same banking details as the "old policy" which should have been amended which means surely they should have just been taking payments (which I'd be equally annoyed about but would have noticed sooner).

Now I'm stuck being told that because they've (though they say I have) cancelled the "old policy" direct debit (can prove I didn't nor my bank and that its a continued one from August 08 thanks to online banking) that I owe £272 for a car I no longer a) own or b) drive. It wasn't sold until a couple of months after I transfered and was kept on private land not moving (wasn't sorn as it still had MOT and Tax which I guess is more fool me cos I thought it would have sold quicker I didn't sorn it).

Can anyone tell me who I contact so I can approach this from a legal standpoint with all the evidence I have to ensure I am not charged this money as this is not my error.

Sorry if this is a bit here and there, am currently extremely angry. I've two kids and I really can't afford to pay nearly £300 for a car I don't own and certainly haven't driven since I commenced the new blue cars ownership (I can after all only drive one car at any given time and that was always the blue one from Dec 08)

    Just type us this question above again and send it out to the insurance company in question.

    I suggest you also check the above question and story again as it gets a bit puzzling in the middle.

    From what I can gather, the insurance company messed up your policy upon switching your insurance to your new car. What it seems is that the person who you talked to made a new policy to make their commission. What a cheek!
    It seems instead of amending the existing policy that have made a new policy and did not cancel the old. That is why you have been charged? Did you cancel the old direct debit yourself?

  • Nope I didn't, mainly as they continued at a lower rate to reflect the new blue car and when I looked at my bank statements and noted the payments taken I assumed all was fine and dandy, so saw nothing wrong (obviously I should have). Besides the fact neither my bank nor I cancelled the direct debit (can prove that as I have a facility on my online banking which shows up and it states on there that the direct debit to close finance who deal with the insurers payments is the same on since Aug 08 with no cessation ;)

    Sorry its all a bit everywhere in my explanation :o

    LOL.... explanation is giving me a headache. LOL.

    Since you did not cancel the old policy they must have been taking money from that anyway. If they did'nt it means that the old policy insurance ceased as the new policy took over. What you will need to do is obtain that monthly statement and prove that to them. Triple check.

    If you are not at fault, you must send a letter! Do not phone! Waste of time! All a bunch of muppets who pass the bucket! If you don't have the address, phone up and say you would like to have the address to make a full complaint!

    This is a complaints department issue and therefore, if you send out a letter like above with more paragraphs! LOL. Vent your anger! Tell them that you have been with them for a while. Tell them your problem! And................finally write down what you would like as compensation! You must state that you REQUIRE that all bad markers on your credit report must be removed! You must also state that a reply letter stating that the marker and the monies owed will cease and be effective. You need this proof for the near future.

    PS. This horrible process will take 3 months to complete! Act now! Don't hold back.

    Surely you got a communication from the insurers giving details of new policy ie policy to cover the new blue car.
    In their letter they will have said if it was an amendment to details.
    Did you get a letter like that?
    If you got a letter saying here is your new policy, then you will have problems persuading them to refund.
    Don't give up tho, recently won two such battles, one of my own and one for my elderly father, you do need to persevere and put it all in writing as recomended above. Oh yes, and obviously keep copies and post all correspondance 'recorded' so you can prove what you're saying.
