Hello Guy's and Gal's. You have been a massive help in getting me this far. This Monday morning I am taking a stroll to the Royal Courts of Justice in the Strand, London and filing for divorce from MBNA, Royal Bank of Scotland, Tesco Personal Finance, American Express and Abbey on the grounds of irreconceivable differences.
Please comment, suggest or provide any appropriate feedback on my intended final proposal with regards I&E on my S.O.A. Huge thanks.
Basic Facts
--> 1-bed flat, rented accommodation in London, sharing with my partner. Just me going BR
--> Partner earns minimum wage, is Polish and needs a fair bit of her income to return to Poland every few months to see family.
--> I have a 12 year old son whom I see every weekened
--> My total debts (all unsecured) are 33k and until last month just to make the minimum repayments and loan repayment was £600 per month
My Income
£1742 net per month (and thats by working a 2nd job one evening a week)
On top of my income I am declaring £200 monthly as my partners contribution (which is what she actually pays / can afford to pay towards rent, bills etc). Do you the think OR will pay much attention to this figure and start asking for me to "volunteer" her financial information?
Expenditure (and justifications)
Rent, £650
Housekeeping, £300 (how much does an OR usually allow a couple? I am hoping to have an extra consideration as I have my son every weekend? What do you think?)
Gas, £50
Electricity, £50
Water, £28 (but currently paying £40 as it's x8 installments) claim for £28 or £40?
Telephone charges, £40 I pay £30 a month (+£10 telephone call costs if any) for combined Virgin basic TV package, phone line rental and broadband). Been advised not to mention broadband.
Travelling to and from work, £141 (seems high but I travel around parts of London due to my job. I could reduce this by not getting a monthly travelcard and using a monthly bus pass, but if I can't access trains and tubes it would make my job extremely difficult to do and have a big impact on my ability to even maintain this job)
Clothing, £40
Maintenance payments, £217
Council tax, £110 (but paying £133 in x10 installments) claim for £110 or £133?)
Home contents insurance, £30
Mobile phone, £30 (going to try and justify this with regards my job. I do get the use of a work mobile during work time, BUT my company "strongly advises" us to have our own personal mobiles as well, because we go into peoples homes and provide support for recovering alcoholics, drug users, offenders and people with severe mental health problems. Encouraged to have access to own personal mobile as well as work mobile in case something goes wrong with work mobile. Sounds a bit far fetched but there is truth in it, OR might view it as complete pants though!!!)
UK Holiday, £25 (hoping to claim in order to fund one UK holiday per year with my son)
Child expenses, £25 (I contribute to school uniforms, shoes and some other items on top of maintenance contributions, this is true, not sure if the OR will buy it though)
Meals at work, £20 (out of the office travelling 60-70% of the time, thought it was worth a shot?)
TV Licence, £12
Dentist, £10
Optician, £10
Prescription, £10 (I often have more than 4 prescriptions in a 3 month period)
Hairdresser, £10
TOTAL INCOME (including partners contribution of £200) £1942
TOTAL EXPENDITURE (assumming i do water and C/Tax as a 12-monthly spread payment) £1808
SURPLUS £134
Perhaps a tad ambitious with some of the above? Please set me straight

yes it may be a problem as the OR will expect all bills to be split 50-50 if they are not they will want to know why.

£300 seems fair but remember if you say its for 2 the OR will expect 50% from your OH

you should not get a IPA as you are on about the same as me after you take of your rent and i never got a IPA,the only problem is your partner as the OR will want to know why you are supporting them at the cost of paying your creditors but you'll have to be ready to answer them questions at the time,good luck:beer:0 -

I was under the impression that bills would only be expected to be split 50/50 if your partner was earning the same money as you?
My partner earns a pittance and if we split the bills 50/50 she would not be able to live here

My girlfriend only moved in April this year, for the previous 5 years I was living alone in this flat and paying 100% of the bills. I don't think I am supporting her, if anything she's support me LOL, as without her £200 a month contribution to my bills I'd be worse off, does that make sense?

I did say that the OR will expect the bills to be 50-50 or the OR will want to know why not and questions will be asked,this is where you would say your OH was on less than you etc didnt think you needed to be told that as you did state that your OH was on less
and sorry but it dosnt matter if she was there or not when you got the debts and paying £200 a month can not be considered supportting you but thats just my take on it and am sure others will have more help for you.0 -

You can also claim £5 per week for children's activities (swimming etc). Re travel to work, if that's what it costs, that what it costs, though I assume this is an estimated average. The worst that will happen with regard to this expense is that you may be asked to provide receipts.

Mighty, if that's all your GF can pay that's fine, it's OK that she has her own commitments and the OR cannot or will not expect her to pay more than she can afford.

Brilliant, thanks so much for this, The Maintenance is not through CSA but I have bank records going back years to prove the payments. The CSA figure based on my salary would be about £260 so I shouldn't think the OR will complain too much as it's lower than it would be through CSA.
I agree with what you suggest out Child Expenses and putting this down as activities, I have my boy every weekend and generally spend £10 or more each time, but we shall see what the OR decides!
