I don't know if anyone can help, but it might ease my mind.
After a divorce my house is finally sold this week and contracts exchanging on Wednesday ! yay.
There is some council tax owing in my ex partners name, does this need to be paid before the sale will go through. Will the solicitor pay it and take it out of the money from the house?

Your Council Tax bill is not connected to the sale in any way. The sale will go through whether the bill is paid or not.Everything that is supposed to be in heaven is already here on earth.

The council can apply for an inhibition order which would stop you selling any heritable property. They usually issue a mandate and undertaking for signature by you and your solicitor agreeing to payment from the free proceeds of the sale and a suitable repayment arrangement while the property is up for sale.0
