Yorkshire Banks Replies to PPI Reclaim

Can someone please give me some advice. I have never claimed on my PPI insurance.

On one reclaim, they have offered an amount much lower than what i am claimng back. What should i do?

On another reclaim, they are disputing that the PPI was mis sold. They have answered that in short, they discussed my pre medical conditons ( i dont remember this), and that my pre medical condition (my back goes now and then) is not automatically excluded from a claim. So if this is the case and a claim on PPI cannot be made for the first 12 month. Would you say it was mis-sold to me?

    Hi there

    So just to make sure I have this right, you have tried to reclaim on this due to being mis sold the ppi product?
    They are not admitted this, but are offering you a goodwill payment, but a low amount?

    I would try to get as much evidence as you can, for instance if this was sold to you on the telephone, ask for the copy of the recordings, this may help back your case and then move this on to the Financial ombudsman service (FOS) here:

    If your not satisfied with the outcome of this, the FOS are another option where they take over to investigate this for you, but there may be quite a wait before your case is being seen to, depending on your current circumstances now, maybe financial hardship difficulties, where you can let the FOS know and they may consider moving this on quicker for you.


    May I ask who the company was or were?
    And what year you taken this out?

    This does not make any difference when really, but just want to make sure they are eligible to be investigated by the FOS, if you wanted to take it this direction.

    On one reclaim of PPI, they have made a good will gesture as they cannot find any interview information. However, this good will gesture is far lower that i am claiming for.

    On another PPI claim, they are disputing that this one was not mis-sold as they have some interview documents, whereby i have agreed to take out PPI in a single policy on their recommendation, but this policy would not automatically have been excluded for my pre existing medical condition if i was to claim on it within the first 12 months.

    This is the Yorkshire Bank and the loan that they are disputing about mis sold PPI was taken out in June 2005

    Hi Gaz

    If this was within the last 6 years if you live in England and Wales, Scotland 5 years, they should hold "all" the information on microfiche, where-as they should still have your information.

    Some companies try to get out of this by stating they have no evidence or information, because its all there in "black and white" in other words mis sold.
    You could be out of pocket here by a lot of money, as there is interest to add as well.

    But if your not happy with the offer the FOS should stand if you want to go this direction,;)

    I am writng to them giving them 14 days to come up with a better offer and the figures i have worked out.

    From that, if nothing comes of it, then i will be knocking on the FOS doors.

    Good idea, I've known higher offers to come in on request, so good luck, and also make them aware if they do not come up with a higher offer you will condsider taking this further to the Financial ombudsman service (FOS).

    [FONT=Arial, sans-serif]Under Loan number *********, although you have offered me the sum of £***** to cover the mis-selling of my policy, I do not think this amount is enough to cover a refund of the premiums, subsequent interest that I have paid on these premiums and the 8% statutory interest that a court would award, but if you were to increase your offer to £******* I would accept and consider the matter closed. If I have not heard from you within 14 days to say if you can offer this amount, I shall be taking my complaint to the Financial Ombudsman.[/FONT]


    [FONT=Arial, sans-serif]Under Loan number *********, I do not feel your letter has offered a satisfactory justification that my policy was sold fairly, reasonably and within my best interests so I request that you look into my complaint again.[/FONT]


    [FONT=Arial, sans-serif]You say that your advisor Mr ******** will have discussed my pre medical conditions with me. Can you please provide specific evidence, that this discussion took place?. Also, you state that the policy does not cover any pre medical conditions within the first 12 months of the insurance, would you concur this as being sold fairly, reasonably and within my best interests after the conversation regarding my pre existing medical condition?[/FONT]

    I have been informed by employer, that i get my basic salary as i am staff, when i am on the sick. Do you think the bank will agree something now. Below is a letter i am sending them. I worked for the same company when i too out the loans.

I can confirm, that my employer has confirmed that as I am a staff member, I would receive my basic salary as statutory sick pay. Therefore the Payment Protection would have been useless to me and not required in the first instance.[/FONT]


    [FONT=Arial, sans-serif]I am writing this, to inform you of this. I will also be informing the Financial Ombudsman Service.[/FONT]

    Dear *************;

    In light of one of your colleagues phoning me on the 27.07.09 asking me about my employment situation regarding my pre existing medical condition, I can confirm, that I receive my full salary, as statutory sick pay.

    Therefore the Payment Protection Insurance was useless to me and not required in the first instance, or thereafter, as the exclusion, although not automatic, which as yet to be confirmed by you, within the first 12 months of my pre existing medical condition, as stated in your letter 21st May 2009, that I knew about, is covered.

    As you state in your letter 14th May 2009, the Your Demands and Needs form, didn’t take into account any existing cover and PPI was personally recommended.

    I am writing this new evidence to substantiate my claim, as requested in your letter 21st May 2009, to inform you of this. I will also be informing the Financial Ombudsman Service.

    In light of this new evidence, I am sending you, if you are now willing to make an offer, this is open to discussion. This would save the FOS precious time as well.
