Please Help ! I've been offered £100

Hello All,
I'm new to this forum but have been reading the posts for quite some time now.
I've put in a claim to HSBC for £700 under financial hardship,i had to fill out an expenditure form which i did.
A lady telephoned me today to discuss my situation further, after about an hour she agreed i was in financial hardship, she then offered me £100 because i have £50 more going out a month than what i have coming in,she said this will help me out until the court case in June.I really don't know what to do next,i then said if i accept the offer of £100 does that mean i'm not entitled to the rest ? she said no it's just to help me out until the court case.
As she has assessed me to be in financial hardship, should i now be entitled to all my charges ?
Please help i really don't know what to do or say next. Thanks.

They can't make full and final settlements so you have every right to reclaim the rest once the OFT test case issues are resolved. Is she putting the offer in writing?

    Hi,
Thanks for your reply, yes she said she will send me a letter, about three pages, then if i want to accept the £100,i will have to sign it and send it back,as soon as they recieve the letter back they will credit my account.Should i accept this payment or will it go against me at a later stage ?
    Thanks again.

I think you should make it clear that you accept this as part payment for the full amount due as determined by the law as laid out after the test case ruling?

No it won't go against you if you accept the interim payment. I would check that the amount offer against the amount you have as outstanding priority debts equal the same, if not then accept but try and ask them to up the amount based on your circumstances specifically.

Thank you for your replies ! I have received the letter from Hsbc this morning,it does state in the letter that they are unable to confirm whether the total claim will be successful, but it will not affect my current claim other than reduce any payment made to me by £100.It also says they require written evidence of my arrears, does this mean i have to contact i.e council tax,for them to write me something to say that i am in arrears ? I have to reply within ten working days, with the relevant account details and written evidence of arrears,it also says 'This offer does not, however, preclude you asking for repayment of any future charges if the courts find them unfair.
Thanks again for taking the time to help me out !

Ask the Council for something in writing with regards to arrears as the bank have asked for that or if you have correspondence with regards to the arrears then take a copy of the letter to send to HSBC
