marks & spencer ppi

I wrote to M&S on 2nd March09 to reclaim my PPI that I have foolishly being paying for YEARS and never claimed as my employer offers a decent alternative and I had no idea it was optional in the first instance. Got letter back from M&S 12th March - need ano 20days to investigate. 8th April rec'd their reject letter with a copy of my application form attached. On the form, yes, there is a tick in the PPI area (probably made by me) which is next to the print in bold that says 'we strongly recommend you take this cover by ticking the box' The reject letter also says that 'when I applied for the a/c M&S acted as an unauthorised intermediary (worrying??) for the sale of PPI as they were not a bank or member of the GISC'. I wrote back to them 20 April saying I was still not satisified with their response as the policy was not sold in my best interests and I asked them to look into the matter again or I would contact the FOS. As of today 15thMay I have had no further response from M&S. What should I do now and who are the GISC?

    Sorry to hear of this, they always seem to reject these complaints even more if the business was not then regulated as such by the GISC, the FSA taken over these in Jan 2005.
    Unfortunately the FOS are only able to investigate complaints if they were covered at the time by these regulators when taking out the finance.

    I would personally ask you local CAB to have a look a this for you and see if they have any options for you here, otherwise hopefully someone in the same situation will post up with some useful advice for you, good luck with this.;)

    I received a 'PM' from Natalie6999 who informed me that the FOS are now considering these types of complaints as there are so many which is very encouraging. After much thought I have sent M&S a legal letter indicating that I will pursue my claim thru County Court. I have had quite alot of success using the Courts, Capital 1 being most recent settlement. So wish me luck!:rolleyes:

    How far back can I claim? Am I restricted by the Limitation Act 1980 or is it that my account should be re-instated as if I never took out the policies? Appreciate your thoughts. Thanks again! G

    Hi. I tried unsuccessfully to reclaim the PPI I had been paying unknowingly (I thought it was Card Protection originally) on my M&S card for years. They couldn't supply a copy of my original application form and said that as I had been paying it for years then I could not claim that I did not know what it was (even though the wording for the charge changed when it went from the Chargecard to the Mastercard). I took it to the FSA who rejected it. I appealed again and they said that as it happened before it came within their jurisdiction they couldn't do anything. I wonder if I kept all the paperwork - might be worth sending in again.

    Good luck withthe county courts Gezza09 - will be interested to hear how you got on.

    Hi Gezza

    Many have been still successful with earlier reclaims, mine was 2001 and some on here have been late 90's.
    Sometimes it helps though if you still have the paperwork to support your cases, older ones especially.
    I would notn say you were actually restricted on PPI reclaiming.
