should i report item not received or wait for refund from seller

hi, i brought an item of ebey total £5.95 with postage.
i contacted the seller as i had not received it he says i will email you proof of postage (not much good to me)
i asked for a refund as he can put a claim in for lost in post with royal mail, he is refusing to refund but says he will put a claim in and refund me when royal mail refund him (this could be weeks :mad:)

should i open an item not received dispute, or will paypal just decide coz he has proof i have to wait !!

if i have a buyer who does not receive item i always refund them and i wait for royal mail to refund me (does not happen to often) so the buyer does not have to wait for there refund !!

what shall i do ??

Put in a claim, that way you are guaranteed your refund, his proof of postage counts for nothing with PP unless he has a tracking number.
Claim now and he can get his money back of RM in his own time.

Yes claim now exactly what lisa said its his respnsibility to get the item to you. If its not tracked he will lose a paypal dispte

was it sent recorded or Special del or just ordinary 1st class? If the latter, then he has no proof really to PP so they will refund you, put your claim in.

just putting a claim in now, will let you know what happens, i expect i will get an email from him
