Reclaiming a small amount - is it worth it?

I'm in the process of trying to figure out how many charges have been made on my Mums huge credit card debt.

I have the details in of her smallest card...Aqua.

Charges are:

March 2005 - £20 late fee
April 2005 - moved onto DMP

they stopped all interest until the balance dropped to £100, then they introduced interest again and decided to charge 3 consecutive late fees of £12 even though the payment was being made via CCCS and had been for 4 years!

So in total £56 charged, my thinking is that £8 of the March 05 could be claimed and all of the £36 charges during the DMP.

I am torn between making a point and claiming the £44 or just forgetting about it (find this hard to do on principle!)

Do you think they will laugh the claim off and ignore since they know that I wouldn't take it to court? - from what I can tell in Scotland you can't reclaim court costs on such a low amount. Also is it possible that they might refund the £36 over the phone? I mean how can they justify late charges when payment is being made via a third party and has been for years!

Just looking for some advice on what you would do?

    I think if you are correct in what you do then you will be fine. OFT842 is the credit card report. If you google it and read it there is a part which I think is 1.14 or 1.18 which states that ONLY a court can decide a fair amount.
    Have confidence in your ability to make them cough up. If you need more advice post on your thread, ok?
