I am looking at moving out of the property i am currently renting but am having trouble tieing in convenient dates for moving. my problem is if i give notice on the 12th june i get back off holiday on the 10th july so dont really want to move two days after getting back but if i give notice 12th july i am into august before i can move
My question is do you have to give notice on the day your rent is due or can you give 30 days notice from any date and agree a part rent with the letting agent?

We've always given notice on the day our rent's due - but we've also always built in a weeks overlap -this has given us time to double check the house is clean (and that we've not managed to leave anything behind!) so we've got the best chance of getting all our deposit back. So you could give your month's notice on the 12th of July, move when your new house is available, and just hand the keys back in when you are finished, or on the 11th of August, at the latest.
The agents we've used have always been happy with this, but you'd need to discuss it with them.0 -
I have given notice many times before on the day the rent is due and have had no problems and i have included an overlap to get house straight but i dont want to wait until august to move thats the problem as it means paying two more months rent which i dont want to do as i want to move into a cheaper property as soon as possible0

The key date is not rent due date but the date in the month that your original fixed term cam to an end, they may or may not be the same dates.
Your one months notice (assuming monthly rent paying tenancy) therefore should end on the same date in the month that your fixed term ended (which is not necessarily the rent due date).0 -
thanks planner if i signed for the keys and everything on the 12th december 2008 (rent due 12th each month) does that mean i then have to give notice from that date? i.e the 12th. i just wondered if this was a legal requirement or whether this was just the done thing?0

Hi Silvercar no not really however hubby is self employed so after not getting paid for two weeks coming up with a bond and one months rent plus moving expenses is not ideal plus i always like to leave a few days after the house is empty to give a thorough clean and to clean the carpets (we have a dog so this is a standard thing in our lease)0

If your tenancy started on the 12th of a month, it ends on the 11th of a month. Therefore you should give one full calander months notice ending on the 11th of a month, and vacate the property/return the keys on the 11th.0 -
ok but can i give more than one months notice can i give notice on the 12th to move out on the 20th of the following month and pay the extra 8 days rent?0

They can hold you to notice that must end at the end of a period if they wish and thus in your above example charge rent till the end of the month. But then you can decline any viewings to find the next occupant if you wish.
So why not ask them if they will relax on the dates a bit? Those that don't ask don't get.0 -
