    Jersey has never been part of the EU, hence European Directives don't apply to them. The reason given by the States of Jersey for introducing the law is: "It is based on similar principles to those found in the UK Distance Selling Regulations and importantly, will help protect the international reputation of Jersey as a place with a well regulated fulfilment industry from which consumers can be confident they will be treated fairly. "

    So you can use DSR against Play.com just as easy as you can against,say, Argos etc?

    Just the part about Jersey TS enforcing, as if the company don't play ball, it does not seem as easy to do as compared with using your local TS.

    But if it is, then the change is for the better!

    I have no idea about the DSR and their application to Jersey, but as far as returning opened goods under DSR, does section 3.40 of this document not suggest you are well within your rights?

    However, if the consumer has done no more than examine the
    goods as they would have in a shop and if that requires opening
    the packaging and trying out the goods then they would not have
    breached their duty to take reasonable care of the goods. In a shop,
    books and sheet music are usually displayed unsealed and therefore
    opening such seals does not invalidate the right to cancel.

    Furthermore:
    However, the DSRs do not link cancellation
    rights with a supplier’s ability to resell items as new.

    I'm curious as everything posted so far seems to contradict this document.

    The link you gave is for England, but does not appear to differ from the States of Jersey DSR regs, see page 27, 3.57 and 3.58.

    Posts on here cannot contradict the law,(well they can, but won't mean anything:D).

    Indeed. Play do state:
    1. Every purchase you make shall be deemed performed in Jersey. Jersey law shall govern every aspect of contractual agreement concerning purchases made from the Site.
