Can I take this back to the shop?

This may have been answered previously but I have had a quick search & cant find any threads.
I purchased a new vacuum cleaner on 04/03/09 from Argos. There are stickers on the cleaner advising if it develops a fault not to take it to the shop but to phone them & gives a phone number.
It developed a fault about a month after I bought it so rang the phone number as advised & was told they would send some new filters & this would sort the problem (although I very much doubt it will fix it long term as it seems to be a design fault & not something fixable). Anyway, a month on they havent sent me anything & Ive had to purchase another cleaner in the mean time (2 children + 1 dog = no cleaner = chaos!)
What I really want no is to take the cleaner back & get a refund. Will I be allowed to take it back to Argos? If so, is there any rights I can quote if they get funny about it?

The key question to ask on who to contact first in these cases is "Who is the contract with"...
Your contract in this case was for the sale of a vacuum cleaner from Argos. So you go back there. And ask politely and calmly, for your money back. And when they say you need to call someone else say thank you very much but no I'll stick with you nice guys at Argos.
Many shops try to get you to go elsewhere (keeps their costs down). Tough, we have rights.

I think before you bought a second cleaner you should have gone back to Argos with your first cleaner.
After 30 days we usually repair or replace items (before anyone flags this up I know it doesn't replace standard consumer rights under the Sale of Goods Act).
I'd take it back to the store and explain your situation with your receipt and see if they will refund you but they may only offer repair or replacement.
If that is the case ask politely if you could speak to the duty manager, there's no point in getting huffed up and saying "THIS IS REDICULOUS!!" as usually it gets one nowhere :rotfl::rotfl:
Try that and see what happens, let us know the outcome.

You are entitled to a refund for faulty goods under s.14 of the Sale of Goods Act. Repair or replacement are additional remedies for consumers if they request it.

Argos are normally very good with returns in their stores.
My advise is to go in Saturday/Sunday morning and you'll be served by a student who doesn't care about their job so will give you a refund/replacement for any reason, e.g. "it doesn't work anymore".0 -
NB You don't need a Receipt, just "Proof of Purchase" - so, for example, if you paid by credit card or cheque then CC or Bank statement is enuf.

Thanks to you all for your help, you have been a big help.
I have just got back from Argos & I very nice & polite when I asked for a refund.
When they said they couldn't accept it as I had to deal directly with the manufacturer I stuck to my guns & told them I had tried that already. After speaking to the manager they gave me a full refund on my card! Yay!
