Request Copy of Consumer Credit Act from Credit Card Companies

    Arguements aside, I believe bert&ernie is correct, they don't have to provide a signed copy for enforceability, at least until they wish to enforce the debt. i.e. take court action.

    If they have sent you a true copy of your credit agreement, you have got what you requested.

    As for being judgemental, it is very easy to blame the nasty lenders for lending the money in the first place, but I fail to see how they are responsible for the unfortunate position the OP now finds himself in.

    This isn't moral high ground - you seem unable to make the connection here - I am not judging the OP based on their position, it is without doubt an unfortunate one to be in, but I am taking issue with the perception that this is somehow someone else's fault because they lent money to the OP when asked to.

    Sadly when people point the finger in blame it is often worth checking where their other three fingers are pointing. Please dont' jump down people's throats just because they do not happen to agree with the obvious path being embarked upon based on the OP's opening comments.

    I see what you are saying, but i think part of the reason the op is in this position is not because he borrowed too much, it's because he's been hit by the credit crunch and they have hicked the interest rates up on the cards. I dunno why these companies hike the interest up, it dosen't help them at all if it puts the customer in a position in which he then can't pay.

    Thank you for understanding my point - it was that we were not unable to pay - the credit crunch is effecting us (like many others) tremendously - our payments are on direct debit (therefore not late), the interest rates continiuously increasing, upon contacting them we were told that they the companies can increase interest rates if we are considered a bad risk (self employed people are) and when we make additional payments the credit limit is reduced to take it to the balance owing! It the interest rate had been kept as it initailly was before spiralling up I would not have had the need to request any info for help.
  • This has gone way of the mark of my request for advice - really knocked me for six - it has taken me a long time to pluck up the courage to go on this forum, try to find my way around, try to sort out our financial problems without jeopardising our future as self employed people! Would not recommend this to anyone - so disappointed.

    Lol - I understand you point as much as anyone else, it's just that I happen not to agree with your intended solution. I have offered details of a number of different sources of useful advice.

    Just because I haven't condoned your imminent attempt to wriggle out of your obligations does not mean that I do not undertstand what you are saying.

    One other thing - some might argue that by reducing the amount of credit available to you your lenders are actually doing you a favour. It must be obvious to them that you are living beyond your current means, and limiting the supply of credit is one ways of preventing you from slipping further into debt.

    There are, you see, often opposing but perfectly valid viewpoints for every point you make - the tendency to talk down those who don't necessarily see it your way is fascinating.

    What did you expect !!!!!! - I have provided details of several non charging sources of advice for those in your situation.

    Attempting to go down the unenforceable agreement route is a sure fire way of trashing your credit rating - which may well be required to be relatively clean if your future self employment requires trade credit.

    I have provded ADVICE. You are 'disappointed' because the advice is not what you wanted to hear. Well I cannet help that I'm afraid. If you just want to hear people saying 'there there, dont let the nasty man get away with expecting you to pay, etc etc' then I suggest a visit to Debt Avoidance Central. Be warned though - those who 'advise' you on there do not have to deal with the consequences for you.

    I'm out, before I'm accused of taking moral high ground again. Jeez.:rolleyes:
