Direct Auto Financial

I took out a car loan with Yes Car Credit in about 2002 which included PPI, which i was told i needed in order for the purchase of the car.

I was then ill and off work for a number of months and tried to claim on my PPI but was told that i could not as it was a pre existing illness which i was told by the salesman was ok and would be covered.

To cut a long story short(ish) the payments went into default and the car was taken off me as i was in no position to pay.

Now the debt got passed onto a company called Marlin Financial Services who after a number of years have benn chasing me for the outsatnding balance. Now after the involvement of solicitors Marlin have agreed that the file is now closed and no monies are outstanding.

I have sine contacted Direct Auto Financial (Yes Car Credit) with regard to the mis selling of the PPI. They have informed me that MArlin have bought all rights to the account and i should contact them.

Am i right in thinking that it is the company who sold the PPI that is liable for any claim.

If so is there a standard letter that i could send to them many thanks in advance.

    Hi there

    In my opinion, you done the right thing from the start by contacting the company that sold you this.

    I would ring the FOS, explain and ask them just to be sure on this, they should confirm who, but as I said above you done the right thing in my opinion.

    It seems that actual company are trying to fob you off, the FOS will or should confirm who to you, just let them know the update so far, good luck and if any help is required throughout the reclaiming of PPI, let us know.;)

    Thats what i thought that they were just trying to fob me off and pass the buck.

    I spoke to the financial ombudman last night with regard this matter and they said that it is the original seller direct auto finance that should be responsible as they sold the product they are sending them a letter on my behalf today to see what their response will be to them contacting them. They will hae more weight than just me writing.

    So its seems they did try fobbing you off then?

    Just because it was taken out of their hands, as you are aware anyway, they still had the responsibility of selling this product to you.

    The chap i spoke to was really helpful. But he did say that PPI was unregulated before 2005 and therefore it may be out of their duristiction but he said to see what they come back with first and then take things from there he said they might back down a bit now they know that they are involved and they wont be able to just fob them off.

    If you still have paperwork on this, then check to see if there is anything on them which states "GISC", these were the regulators before that of the FSA who taken over in Jan 2005, if this is the case the FOS will consider investigating these complaints anyway, good luck.;)
