Hi, I am currently in the first line informal appeals time against a Manchester Council PCN, I sent off my appeal stating my case and am quite confident it should get through, I also have covert recordings with the CEO admitting of the unfairness in issuing the ticket from the rules given by their seniors but am holding on to that as a means of contingency usage.
Is it true that the 56 days rule for a response to be served to the appeal is only valid in the second line of appeals? after the informal appeal has been rejected and when it is onto the formal representations?
I have been trying to find this in writing, I remember coming across it once in a download off the Manchester Council's website as a PDF for something but can't seem to find it now.
Is it a governing legislation that states this time frame? if so, which one is it? and if someone could just clarify whcih line of appeals that "rule" applies to?
I would actually find it more fun winning the PCN on a successful challenge instead of a timeframe thing, but that's just me.

As there is no timescale that applies to informal challenges then there is nothing to possibly link to.
There is also no explicit requirement to respond at all. Keep your eyes peeled on the post for the Notice to Owner.0 -

Its in the secondary legislation listed on your PCN. CEoPC Gen Regs or the reps and Appeals Regs.
you can search for them if you type the title accurately in the 'opsi' website search facility. too late for me!

why does it matter to your case anyway at the mo?
DfT recommends 21 days but 56 is Statute.0 -

read it all then!
if you search just for the CEoPC Gen Regs (typed in full) and leave out (England) but include 2007 then the two relevant sets of regs come up top of the list.0 -
