Last Tuesday I attempted to purchase a PAYG mobile from Ebuyer mobile. On finishing the online order I got a screen saying order was processed and Id receive an email. No email arrived and I noticed that my order number was -1. I rang up and the girl on the end said they had no record of the order, so try again.
I tried again, with the same problem. On ringing her back she said she couldnt get on the system to place an order herself so the system must be down - she said she'd ring me back the next day to make the order herself. She did ring back, but Id already found the same deal cheaper on another website.
Since then, I have had 2 charges for the price of the phone (£40) on my credit card from their distribution company, Shebang Distribution Daventry. On ringing back ebuyer, who confirmed they used shebang, they said they still had no record of my orders and she would ring head office and ring me back (which she didnt). After I rang back late friday afternoon, another girl said she would ring back today.
So, Im just wondering what my rights are. Ive had no formal confirmation of orders or receipts, no confirmation of dispatch or anything. The goods have not arrived yet, but if they do, Id expect them within the next couple of days.
How should I go about this? contact ebuyer, or shebang, or my credit card company? Is it best to keep ringing ebuyer regularly (like every 2-3 hours but politely) until I receive an answer? If the goods do arrive, do I charge ebuyer for the cost of return postage, or if they are sent recorded, can I simply refuse to accept them?

I would go direct to the credit card company. If Ebuyer say they have no record of your order, then clearly they or their agents (Shebang) have no right to charge anything to your credit card.
If the phone(s) then turn up, you should treat them as "Goods sent in error" which allows you to set your own (reasonable) terms for Ebuyer to recover them from you - at their cost.0
