Being charged overdraft fees on overdraft fees

I am currently being charged for going overdrawn due to being charged overdraft fees which I had been told had been reversed and would not come off my account. After long negotiations on the phone I have persuaded them to remove this overdraft fee too, but they warned me that I will be charged again next month as I have been overdrawn this month. I argued that the overdraft this month is caused by their charges which they shouldn't have made. They are not agreeing that this is wrong.

More detail

This all started just over a month ago because I was charged £15 unauthorised overdraft fee and £32 mandate charge for going 71p overdrawn. I went into town and immediatley paid the 71p back in to my account to put it straight, and then phoned the bank to explain this and was told that they would refund the charges as a goodwill gesture.

This month the £15 still gets removed from my account and puts me overdrawn. I phone the bank to explain that I was told that this charge had been reversed and shouldn;t have appeared on my account this month. Their arguement was that it says in my terms and conditions that they can only make on goodwill gesture per year and that the £32 and £25 are two charges. I reiterated that I was told on the phone that "the charges have been removed" but they said this would not be possible. They stated that I should know from the T+C that only one of the amounts would have been taken off and I replied asking how I would know this is the case if I had been told on the phone that they would "refund the charges".

After lots of argueing this morning they have agreed to put the £15 back in my account, but have said I should put funds in to cover the unauthorised overdraft fee that will appear next month due to this charge that they have made and refunded again this morning. They made the charge today and I was on thephone to them at 8.20 am and it was refunded by 8.40am.

Should I have to pay next months £15 for an overdraft that was caused by their charge that they told me was not going to appear.

Any advice or if anyone has been in this situation before then and wisdom from experience would be greatly appreciated.

I feel fairly helpless to this and can only envisage an ongoing spiral of charges and arguements.

    I think you need to write to the bank and explain in a chronological order that it would appear a bank error has occurred and you are in a spiralling bank charges--then refunded---then bank charges again. See whether they will refund and sort out the problem for good.

    I hope you get it sorted, I have a CCJ against me now for the same thing, as I wasn't in a position to pay them back :(

    I am with HSBC I went over my overdraft by £50 a couple of months ago. I phoned the bank to ask if I could increase my overdraft by £50 to stop me incurring any more charges. This was refused they say not to be my credit worthiness but to the current climate. I was subsequently telephoned by a customer adviser to ask about my overdrawn account, I explained I asked for an increase in my overdraft and was refused but he went on to ask if I wanted to consolidate a new loan. I said the loan I had with them was at a rate of 4% and a new one would be considerably more and was surprised that they could offer a new loan but would not increase my overdraft by £50. I complained in writing stating that they were charging me on charges as they seemed to deduct the charges the day before payday. They categorically stated that they do not charge on charges it is not their policy. I checked my bank account today they are deducting charges the day before payday! Anyone out there any advice as I have everything in order then out of the blue another charge is added so every month they are taking money off me?

    I think you need to ask HSBC how their charging policy works because you seem to get charged just a day prior to your payday. See if you can get the charging period changed if they will do it.
