I sent this:xxxxxxxxxxxxxCapital One Bank
XXXXXXXXXXXXXX
XXXXXX
XXXXX

Dear Sir or Madam,
Account number: XXXX XXXX XXXX XXXX
REF: ERC/JTL/XX-XXXXXXX
I am writing in response to your letter, dated 17th April 2009, stating the following:
“I've reviewed your account and as the default sums that have been applied to the account are £12 and correct, there is no refund to be given”
I would like to remind you of the exact wording of the OFT recommendation:
“The setting of the threshold is a provisional practical measure to move the whole market towards compliance. We are not proposing that default fees should be equivalent to the threshold, and a court will certainly not consider that a default fee is fair just because it is below the threshold. Our position is that default fees need to be recalibrated in line with the principles set out in this statement to achieve consistency with the UTCCRs.”
I repeat, I do not believe the charges reflect the true cost to Capital Oneand are unfair and disproportionate. I therefore ask that you repay me the full amount of £283.38.
I expect a full settlement to this complaint within 14 days. If I have not received a refund from you by the 8th May 2009 I will commence court proceedings to reclaim my money.
Yours faithfully,
XXXXXXXXXX
Sent an identical one to Vanquis. Vanquis have offered a full settlement after 4 weeks, from the first letter, Capital One have ignored letters and won't allow me to speak to the ERC Department / Author of the letter. Court here I come.
Just Download the FOS form and attach the letters that you sent to Cap1 and their replies.
I wish you all the best, any problems you know we are here to help you.0 -

I claimed financial hardship with halifax 9wks ago, recieved a letter yesterday from them saying after my recent correspondence from customer relations they were writing to make me aware of a service which is available to Halifax customers with financial difficulties
Does this mean they are not accepting my claim????? Any help would be greatly appreciated folks!!:p:p:p

Under the Banking Code the bank has to offer assitance to customers experiencing genuine financial hardship.I claimed financial hardship with halifax 9wks ago, recieved a letter yesterday from them saying after my recent correspondence from customer relations they were writing to make me aware of a service which is available to Halifax customers with financial difficulties
Does this mean they are not accepting my claim????? Any help would be greatly appreciated folks!!:p:p:p
This can be a variety of measures from reviewing your DD's & SO's, changing your payments cards, even changing to a basic account that won't allow you to incur charges.
Under the FSA waiver banks are not obliged to return charges even if you in hardship, what they will probably do is offer you a goodwill gesture that will allow you clear arrears and alleviate your hardship. Any amounts that are still owed to you can then be persued upon completion of the test case.
If in doubt ask for advice here before agreeing to any offer from your bank.0 -
