Capital One ERC Department

I am in the process of trying to claim my charges back from Capital One.
I have recieved 1 letter from them stating that the charges are fair based on the OFT recommendations. I replied stating the exact quote from the OFT recommendations, namely that a court will not find that a charge is fair just because it is below the threshold, I gave them 14 days to respond. That ran out today so phoned the contact number and spoke to an extremely rude woman and a dismissive and argumental manager. This manager said that I should write to ERC Department. He claimed that he could not give a number for them or to transfer me, but said that he would place a note on my file for them to call me.
Has anyone dealt with the ERC Department before or even do you have a contact number for them?

    Also, never speak to them - you need things doing in writing or you have no proof. Put it this way, try and argue in court that the woman was rude - prove it? See my point :confused:

    Good luck, but please stick to letters - always safer.

    Well Carlos its quite obvisious that they (Capital One) will state themselves fair. Anyhow they would want to skip your problem and may stick to their words. Once one of my friend was faced with that kinda problem. I don’t know that time he even knew that he should contact with that ERC department. After reading your post I just came to know about that. But I am afraid I don’t have any contact number of the ERC department. But I would be grateful if you post that number when you will get it. thanks.

    Thanks never-in-doubt. 1st and 2nd letters were both template letters, but with slight modifications. 2nd gave them 14 days to respond before I file with MCOL. That ran out yesterday, I thought I would try to speak to someone. Anyway I get paid on friday so that gives them 1 week for the mythical ERC department to contact me as promised. I can't file now as don't have the money to pay the fee!

    i'd be doing the dispute letter mate, not court action.

    Cheers sandravan. I have their address but they have ignored my letter. I tried to speak to them on Friday but only got hassle from Customer Services, the lady I spoke to interupted me with "Right your majesty". That's when I demanded to speak to a Manager. At the moment I just want to cut up my card and post it back to them. My balance is £223 and they owe me £307. I just want to forget Capital One, but I want my money back first.
