Advice needed please

Bought a ds original from ebay for £38 inc pnp. listed as "NINTENDO DS SPARES REPAIR" description was "IN FULL WORKING ORDER BUT HAS NO CHARGER. COLOUR IS PINK WITH WHITE BOTTOM. NO GAMES SUPPLIED"
emailed the seller before bidding to check why it was listed as spare/repair and they said "lack of charger that's all. easier to say spares or repair than someone buy it and complain to ebay or paypal that it has no charger with it which has happened before."
no problem about no charger (or stylus:confused:), already got them but I disagree that it is in 'full working order'
received this morning, and the bottom screen doesn't work properly, where you touch screen is not where it shows iyswim (is wayyyyyy off) which makes it impossible to use. tried to calibrate and just will not work, just keeps going round in circles, from researching on net, looks like it needs proper repairing and will cost more than I paid for it!
What would you do? Will obviously need to contact seller to say it doesn't work properly but then what?
Sorry if this is a dumb post but I'm not sure if their listing as it being for spares/repair outweighs the full working order comment iyswim and grateful for any advice

    I got a DS off Freecycle that was offered as having a faulty bottom screen. I paid £6.99 for a new screen and refitted it by following a video on You Tube. The DS now works perfect and came with all accessories and 2 games, so all in all I paid £6.99 for my DS. :j

    Yeah, they've slightly mislead you on the 'fully working' bit, but that's probably just so they could get the sale (... i.e. they actually knew it had a faulty lower screen but were worried it would put people off).

    I would contact them and just find out why they said that the problem was with the missing charger, and not the screen?

    Re-list it and I'll buy it off you and replace the screen ;)

    I may just be ridiculously lucky, but I have in the past won a Not as Described dispute over an item that was described as being faulty. It was described as being a simple fix, but when it arrived, it became apparent that there was also damage to the item which would hae made repair much more difficult and costly.

    I'd have written it off, but the sellers attitude stunk, so I put in a claim, returned it, and got my refund. :D

    selelr replied to email saying "send it back and i'll sort it." (man of many words lol) and when asked what that meant said "fix it or refund you. when i tested it i played mario so didn't need the stylus hence why it was missed. i'll prob sell it on ebay for spares stating the problem"
    what happens if I send it back and never hear from him again? even sending recorded there's no proof of what I've sent him iyswim
    really getting confused now. do I send it back recorded and hope he refunds? open a dispute and risk losing? relist it myself stating problem?
    (oh and lil, LOL might still be an option to relist if I get no joy)

    It's really up to you, you could cut your losses and list it for what it really is, i.e. faulty screen, needs replacement.

    However, they seem keen to accept it back and refund, so I would go along with what they've offered. Send it via a trackable method so you have the tracking number if the need to claim arises - I think if you went through the Paypal claim route they would ask you for the tracking number anyway so Recorded will suffice, as far as I'm aware.
