BOS credits - Now want money back!

I don't know if any of you can help me.

I have a Business Account with the Bank of Scotland

Over a year ago I found that I was getting some credits that I could not identify.

I complained to the bank and they investigated and said that they were payments from the Natwest but that they could not trace them any further. However, they said that as they were for my company name they were credited to me.

I asked them to investigate this further and still they just came back with the same infomation.

The payments then stopped after 12 months.

Now the bank have come back a third time and said they made an error and credited them to my account incorrectly although they are blaming the Natwet for this.

They are now saying that I owe them £2340 imediately and will debit this from my account (which holds about £60) in 10 days.

As a very small business I certainly do not have this sort of money available as a lump sum and after 2 complaints and being assured it was correct I used it to incest in the company.

Can you please advise me what I can do, if anything at all.

    sorry it's not what you want to hear but if the money has been credited to your account in error they can recover it. check t&cs. you should never spend money you know is not yours because banks will pick up all overpayments eventually- it's just not worth the risk. ring up them explain you don't have the money and suggest a way of repaying it in installments.

    The fact that you contacted them saying you thought the money had been creditted erroneously but they still said it was correct does give you a slightly stronger hand with which to bargain.
    Write to them pointing this out and that in the circumstances you think it would be good customer service for them to take a lenient approach. You could also ask them how they would rate the service they have provided you.
    Make them a reasonable offer of scheduled repayments if they refuse to play ball take your case to the press and you 'might' get the debt written off. If baks think they are going to be named and shamed in the press for poor customer service they often change their tune.
