IPOD Touch 32gb faulty

Bought an Ipod touch 32gb for hubbys birthday in mid March. It has stopped holding its charge now and you have to constantly re-sync it.
Spoke to [EMAIL="Dix@ns"]Dix@ns[/EMAIL] who stated that they would send out packaging for me to return and they will either have it repaired or replace it with a refurbished one! After my sense of humour failure at getting an exchange with a refurb she stated that the refurb would be new and not used.............so why call it a refurb????:mad:
The flammin thing is literally 7 weeks old and they expect me to be happy to be exchanged for a refurb?? Can they do this??? Not freakin happy that I pay over £200 for an item which if they cant repair could be exchanged for one which is not new.

- If you have only had the phone a few weeks or haven’t had a reasonable opportunity to check it, you are probably entitled to a refund for a fault or poor description, or alternatively you may request a replacement.
- If the fault is only minor and can easily be put right, it is reasonable to accept a repair. This won’t stop you claiming a replacement or refund if the repair turns out to be unsatisfactory.
- If you have had the phone longer than a few weeks or have had a reasonable opportunity to check it, you are probably still entitled to a repair or replacement. A repair should be carried out within a reasonable period of time and without causing you significant inconvenience. Any repair should restore it to a satisfactory condition. If this does not happen, you are entitled to a replacement or compensation. This could be a sum of money or the cost of having somebody else repair the phone.
I would go back and ask for it to be replaced with a new; boxed one. Failing that ask for a full refund...

Apple store near you? They may well swap it without getting dixons involved and customer service is 2nd to none IME.
