Does anyone have the number of Capital One's ERC Department?

I'm trying to get £283 of charges refunded from capital one. My last letter gave them 14 days to reply. They haven't and time is up today. Their last letter, stating that the charges of £12 are fair:rotfl:, gave a contact number as 08458400400.
Well I've just spent 20 mins on this number with the first person, Clarice, persistantly asking me to pay the amount that my is overlimit by (£23) and repaeating that a refund (£12) had been made at easter. After she started a reply with "right your majesty":mad: I demanded to speak to her manager.
He started to repeat to me about the easter refund, when he eventually realised what I was asking he said that I had to write to the ERC Department and that they had no phone number or internal line that I could be transferred to. He offered to put a note on my account for them to call me, I asked him how could they do this if had no phones?;) I reminded him that the OFT stated the £12 charges could be contested in court as they were merely a provisional measure and that they did not propose that default fees should be equivalent to the threshold. He then rather curtly asked my why I thought I should not be charged for exceeding my credit limit. I hung up:mad:
Basically if I haven't heard by 4pm today I would to speak to someone in the ERC department.

Carlos, slap wrist, you should have said that you are quite happy for Capital One to charge you a fair amount that is decided by the law courts.

Thanks NW I read my entire letter to him and reminded him the the OFT quote about how a court would not consider a charge to be fair simply because it was below the threshold and that when he asked why I felt I should not pay at all. I hung up the phone as after 20 mins of repeating myself I could feel myself becoming unwell, I'm getting over a period of stress and depression.
I have no idea what the ERC Department is, I have tried to google it to no joy, there is no mention of an ERC Department in my letter from them apart from the reference starting ERC. If it wasn't for this reference I would suspect that he is making up random letters!
Needless to say no-one has phoned me back today.
Roll on next friday when I get paid and I can file a claim with MCOL. I'm looking forward to hearing Capital One explaining to a court how much it costs to determine that my account has exceeded it's limit and how much it costs for my payments to be late by 2-3 days. When they can't account for £12 of costs I will ask them to explain how the extra amount is not a punitive charge and thus unlawful under the UTCCR's. I am not disputing that some degree of charge should be levied but insist that it should be fair and proportionate to the costs involved.0 -
On the letter accompanying the list of charges sent to me by Cap One,as a result of my SAR, the reference is ERC/...... and the phone no 08458 400 400 is given.
I haven't tried this number but no doubt it asks you to enter your account number. If you are in arrears or overlimit most lines into Cap One will take you to collections, DON'T enter your account number when asked, you may get somewhere different0 -
It's their Executive Office here in Nottingham.
I had my charges back from them in Sep 2006 (had to register a Moneyclaim but they caved in before the hearing - this was before all the cases were stayed).
The telephone number on their letters at the time was 0800 9525150 - hopefully it won't have changed.0
