Hello there, I was wondering if someone could help me, my husband and I took out a loan in October 2004, this loan has now been paid back to the in full. When we took the loan the sales person told us that if we didn't take the PPI that the loan would probably not be approved, so we took it as we needed the extra money to get married.
I sent them a letter a couple of weeks ago and they got back intouch and told us that we have no proof of being miss sold the insurance and that we signed the agreement for PPI, they also say in the letter that "Although Black Horse Ltd is now subject to the Financial Ombusman Scheme for General Insurance activity, this was only from 14th January 2005." So they are saying that even if we go to the Financial Ombusman they would not be able to help us as we took the insurance 3 months before they became part of the scheme. IS THIS TRUE!!!

sorry to say but it is true,
but dont give up there are options.
russ2000 has just posted a response letter on another thread, adapt that for your second letter & see how you get on.
others will help with more advice aswell.

Unfortunately yes its true, the FOS are unable to investigate complaints if they were not covered as such by GISC, where the FSA taken over in Jan 2005.
I don't think BH were covered by GISC either.
You will find many on here with the same problem with these and in the same situation as you. Check the threads out to find out how they are dealing with their complaints.
Its always the same when the companies were not under jurisdiction, they fob off, just because your unable to take to the FOS.
You could try writing back to them and tell them you are aware you cannot take to the FOS, but you can consider other action to retrieve the refund of what is owed in regards of being mis sold the PPI, plus the interest.
This is just another way as there are other ways, such as small claims courts, but check what money would be involved, bu going this direction, check here:
