Help in getting information from Insurers

Shortened version of the tale so will keep it as brief as possible.
Insurance claim lodged in March of last year and ongoing problem with leaks in under floor piping.The claim has escalated now that we have got to move out into rented property for remedial works to start.Prior to this the insurers requested I allow a forensic engineer to come to the house and go through the whole situation which I agreed to . He spent a good chunk of the day asking many questions and looked at all the damage caused, work that has so far been done and pictures I have taken throughout and also did a risk assessment. He said a report would be submitted to them. I have asked to see the report but they have refused.
I want to see the report for two reasons
1. As I was the major contributor I wish to make sure what the report says is an accurate account of what has happened
2. We maybe lodging a complaint to the Financial Obmbudsman for possible negligence and think the report will hold key information to substantiate the complaint.
I have tried the Information Commissioners Office to see if I can use the freedom of information act and they said no as it was specifically about personal data so not sure what else I can do ? Any ideas ?

Yep the DPA is unlikely to help you here.
I really don't understand what reason they could have for not letting you see the report. I could guess that an ongoing complaint could cause someone there nervousness but this just seems silly. The insurer will have to send their file to the ombudsman if it goes that far anyway so this report should be included.
Have they given you a reason? Who is the insurer? Are you already into the official complaint procceedure?0 -
freedom of information act
Freedom of information act has nothing to do with commercial entities. A data subject request (which is possibly what you are referring to) wont apply either as that doesnt mean they have to supply copies of everything they hold or have ever held on you.
The insurer may be witholding the report as they requested and paid for it and its for their benefit, not yours. The first level staff may not hold the required authorisations to issue copies and automatically say no. Or if you have already made a complaint, then they may be witholding it as part of their investigation into the complaint.
You should be focusing on the claim and not issues like this. If you dont think the claim is being handled correctly then complain.I am an Independent Financial Adviser (IFA).
