Blackhorse mis sold PPI

Hello,

like others here i've been mis sold PPI from Blackhorse Finance and despite sending them letters and complaining to the FSA they are sticking to thier guns and insisiting the policy was not mis sold.

I'm now thinking of going to court as i'm fed up with their arrogance and i'm looking for a bit of help with creating a letter to send to them before i lodge a claim with the courts. Can anyone help me with a suggested letter before action? The basis of my claim for mis selling is that i was never advised it was being added to my loan and i also had a medical condition at the time i took out the loan, that meant the policy was worthless to me.

I'm in Scotland by the way just in case it makes a difference

    Okay just to make sure I have this right.

    You have already complained to BH and they given the "final response", then you had taken this to the Finanical ombudsman service (FOS), and they are sticking with BH decision, is that correct?

    In regards of my above post, if the FOS are unable to help, then maybe small claims would be one of the best directions to take here, however I am not too sure how this works in Scotland, so I have posted to "Melorablack" who may be able to give you some info/advice on this matter, hopefully she will be along tonight or by tomorrow.;)

    As you have already been turned down by black horse and they don't seem to be budging, as Di said, I would recommend going to the FOS (if you adn't already) before going through the courts, especially because the fos is free to use whereas court costs could potentially wipe out any refund you may be due.

    Hi Trieshard,
    if your willing to go the court route yourself you would get all the legal advice you need off the consumer action group, CAG.
    Their are people in the same situation as yourself & to what i know if it is small claims it is not expensive, maybe time consuming thou?

    Thanks everyone,

    the claim in question was before 2005 so i cannot complain to the ombudsman but i have complained to the FSA, alsthough they just referred everything back to Blackhorse who stuck to their guns, and issued their final response again.

    I'm happy to go to court as the policy was mis sold and i feel that after all this time, (this has been going on since October last year), it needs to be sorted once and for all. I can't see any onther way really
