Hi,
My wife currently gets 25 days holiday plus bank holidays. She is ideally starting maternity leave about 1st September.We were under the impression that she would get her full years entitlement i.e 25 days. However her boss is saying it is pro-rata so would only get 16 days(8 months x 2). Who is correct?

what he probably means is that they will only pay her what she has accrued to date when she starts her mat leave but she will certainly still continue to accure whilst she is off

Boss is probably saying she can only take 16 days prior to her mat leave starting - a lot of mums use up holiday accrued first before starting official mat leave. She will of course accrue leave at her current rate while on mat leave.
One point I want to make tho is if she goes back part time after mat leave, she is still entitled to the leave accrued while on mat leave at the full time rate. i.e. if she takes 1 year off on mat leave, she is still entitled to the 25 days leave prior to returning to work even if she then comes back part time. Obviously she will then accrue leave pro rata. I know of a couple of mums who didn't know this and who have lost some leave entitlement on returning to work part time.0
