    Thanks for the reply,

Littlewoods rings a bell, I can remember having an account with lxdirect catalogue i think, the cabot account is in reference to an old next account, i cant find a next account on my file thats defaulted, there is one on there and here are the details:

    my name, and current address:
    NEXT DIRECTORY
    started 10/11/08 balance £0 settled 30/03/09 credit limit £150.00
    status history 0
    last updated 12/04/09

the strange thing is i have never applied for a next account at this address because i knew i wouldnt get one so didnt even bother with it... and the dates do not match the cabot info.

strange, also can i ask what 8 is in reference to in the status history ?

    thanks

    wayne.

Right, if it was LX Direct did you get the card to use in stores? This is important, did you have the littlewoods card that u could use in stores...?

Also, 8 usually means default and/or 8 payments late so defaulted. You need to try and remember what each account is....

Just noticed, the next account is a live account! This means you must have bought something online with next and they approved you a credit account! Try to log-in using your email address and usual password and see......

Or click the forgot password link - it will be linked to your email address of November 2008. Think back, you must have bought something round then, from next online....

That entry to me shows a credit account with a £150 limit and £0 balance and upto date..... lol.

there was no card to use in any stores, it was a mail order catalogue opened over the internet.

I have tried the next account, and it states credit or debit card payments only, i have never purchased anything from next at this address, i do remember requesting a catalogue from them ages ago i guess thats what its all about lol

but the account is no longer a credit account, its card payment only.

Thanks for info..... ok, so with Littlewoods this shouldn't matter too much cos most their CCA's do not conform to prescribed terms and most of the older littlewoods CCA's actually forgot to mention they could share info so should be a formality - I recently had a default removed by C.A.M/Phoenix easily enough - 2 letters and it was gone.

Regards to Next, ring (or email) Experian and get the full account number of the account as they will have to issue you it, to make it seem fair ask for the full account number and contact details of all 3 entries, the two defaults and the Next account and this way we'll be able to figure out what is going on - when they respond, you need to send any letters I do to the addresses supplied by the Experian and quote that reference number.

With Next, i'd suggest when the CRA give you the a/c number to ring Next quoting it and asking 'have I got a credit account' and if they say NO then ask why it reports to the CRA as a credit account with a £150 limit - can they check.

If they confirm that it is not a credit account then request closure immediately and removal of all entries from the CRA record. We can write in if necessary but worth asking first because if it is a live account then i'd say keep it - I mean most people use Next!

Remember to keep in touch when you get Equifax report through....

  • NID (aka The Oracle! lol)

Please help me write a template to Crap,1 ??

Here is a breakdown of my situation:

Cap.1 issued a default without my knowledge, The first I knew of any problem I had a call from a company acting on c1's behalf which said I owed money which I paid immediately - no mention of this Default!! Default date was: March 2009

I sent them a letter which i found on this link :
    learnmoney website under : credit-file/remove_default_notice.

To which they responded that as my account balance is zero and is not going to change they are not obligated to provide documentation under section 78 of the CC Act 1974.

I don't know how I get can around this legislation to get proof of my default and if I can prove it was never sent (which it wasn't) how likely is it that I can appeal and have this removed?

I can be online anytime to discuss this, give me a time / date and i will be here! Also I can email you copies of all correspondance that i have sent / recieved so please let me know.

Thank you soooooo much! Natalie

    Hi Natalie,

Have a read of this, it was a letter I done that was then recently sent to Crappy1 on behalf of another user: http://forums.moneysavingexpert.com/showpost.html?p=23649967&postcount=240

But personally, i'd have a little read from here (only 2 pages worth) so you get an overall idea what has happened and maybe the letter they sent him will be similar to what they sent you..... Read this: http://forums.moneysavingexpert.com/showthread.html?p=23343031#post23343031

Just to update you, I've sent the Letter Before Action and my POC is below...just wondering if I'm on the right track?

    1. Claimant held a Current Account with the Defendant, xxxxxx, from September 1998 to December 2006.

    2. A 'default' appears on the Claimant’s credit reference file relating to the account.

    3. The Defendant;
    a) Has failed to comply with a Statutory Notice issued by the Claimant pursuant to s.7 Data Protection Act 1998.

    b) Has applied the 'Default' without complying with the requirements of s.87
    Consumer Credit Act 1974.

    4. The Claimant respectfully seeks;
    a) Rectification, blocking, erasure or destruction of the inaccurate data, which theCourt can order under s.14 Data Protection Act 1998 – including details passed to the Credit Reference Agencies.

    b) Costs and damages at the discretion of the Court under s.13 Data Protection Act 1998 due to the damage to the claimant’s creditworthiness. The claimant has suffered a significant waste of personal time in pursuing this matter through the correct channels.

Just issued court proceedings against Abbey. I will keep you all posted. I am simply asking for removal of a default and minimal costs. The clock is ticking
