Just received my SAR and got off the phone to someone at Three's Executive Office - a pointless conversation reallly.

"It is illegal for us to remove a default from your credit file, as a true reflection of how the account was maintained must be shown."

Same thing I keep getting told. The SAR information hasn't made much difference either.

I think I might just call it a day actually, only 3 more years till it falls off anyway :o.

    Cheers for the help NID.

    Hiya

Ok, that was to be expected so please send a cover letter with a copy of the original letter and demand they deal with the issues in hand. So just do a few lines saying 'please respond to my original request otherwise I shall seek enforcement through the county courts'.

Good luck..... (this is their way of stalling and they are trying to buy time!)

Are you writing to marbles or the DCA? If Marbles, send letter here:

    Marbles Card Services
    Data Protection Officer
    Complaints Resolution Team
    Pitreavie Business Park
    Dunfermline
    Fife
    KY99 4BS

Thanks NID, I will send it to that address. I sent it to their official Halifax office address before, but got the reply from customer complaints. I'm not dealing with the DCA anymore, haven't since November time :D It's as if they haven't even bothered to read my letter, it's so infuriating. Without this 5 payment marker my file would be OK!

Ok, no need to wait 3 years - if you want it removed you need to fill me in mate as I don't know much about your situation! Bottom line is that it is not illegal to remove one - haha! They don't know their ars from their head!

Give us some details and i'll do you a letter, see if that helps. SAR is a waste of time, as originally advised - waste of a £10-er

Halifax still haven't sent my SAR dating back to February so I do believe you - they are what is known in the industry as a shower of !!!!!!!

Just send it there and see how you get on, obviously you do not send another £1.... you just say further to my previous letter - deal with the questions I asked or remove all data as the account is unenforceable and disputed and until they can prove you had the debt, they must remove all data registered against you...

    Best of luck ;)

Their letter is also dated 10th June, but I only got it today - also the date is wrong as I sent my original letter on the 12th June! How can they have replied to a complaint when I didn't SEND the complaint until the 12th!!! IDIOTS :mad::mad::rotfl:

How many days should I give them to respond? Baring in mind they've had 3 weeks+ already. 28 days? or 14 days?

Lost track of this thread for a while.
Good to see it is still going.
  • Does anyone know if the monthly payment scores on your credit file, ie 0,0,1,0,2 etc if you don't make the min month payment say for example you only pay £35 instead of the min.monthly of say £75 does the credit card company/bank etc enter that as a "0" or a missed payment "1"?

    It'll be recorded as a 1.....

If not, then we'd all do it month in / month out knowing it'd cause no harm! but yea, deffo shows as late payment.
