Capital One PPI reclaim

Hi all,

Just a quick update on our PPI reclaims, we had the usual fob off letters from Capital One and Lloyds saying that had recorded conversations saying that my BF was not missold ppi and that he willingly agreed to it which we know was a load of boll*cks so we wrote back giving them the
14 days before going to FO.
Hey presto we got a letter back yesterday stating that as time has passed since the sale of the ppi they are unable to provide us with a transcript of the call. As a gesture of goodwill they are offering him £427.49 in premiums and £34.20 in interest but will deduct it off his balance. We reckon they owe him around a £1000 plus interest.
Whats our next course of action to claim the full amount owed and to insist we have a cheque for this rather than deducting from the balance.

    Arn't they crafty??:eek:

    I would go to the FOS anyway, if they had the recordings then and have only just investigated, then they should still have them, seems ratehr weird to me.

    I would write back and ask them for the whole lot paid directly to you or you will go to the FOS with your reasons.

    Hope your well and thanks for replying. Yes they are very crafty and playing the game very well but then so am I :rotfl:
    I told my boyfriend that they were just bluffing saying they had a recorded transcript and that when we asked for it they wouldnt be able to come up with the goods, im glad to say I was right and im now going to draft up my next letter asking for the full amount and to be paid directly rather than deducing off the balance.
    Also, we had another letter from Lloyds who after initially writing to them on 09March reclaiming PPI and then again on 20April after hearing nothing from them in reply to the first letter, have now come back to us asking yet for more time to investigate as they are not in a position to complete a final response. They say in light of this you are entitled to go directly to the FO. Sounds very much to me like they have no intention of settling this so suggest we go to to FO.
    I know you had a successful claim with Lloyds, do you think I should give them a little more time or if I do that will they just keep stalling anyway.
    Should I just take the case directly to the FO now??

    This is Lloyds TSB all over.
    If the 8 weeks have passed and its not complete you can now ask the FOS to investigate this for you.

    However, after 8 weeks, as its your choice, if you want to sort of give them your own timescale, like say a fortnight as from now, if you hear nothing then - then go to the FOS.;)

    Thats exactly what I thought, i read somewhere that 95% of Lloyds reclaims with regard to PPI have to go to FO which shows their track record for resolving these issues. However I will write back saying I think they have had enough time to look into the matter but I will give them 14days to investigate further after which I will then refer the matter to the FO. Can`t say any fairer than than that.
