Hi all again,Still waiting to post attachment, but have an update on my situation.Having checked through my old paper work, what joy. I have found that this debt is outstanding from Nov 2002; as far as I am aware no payment or correspondence has been sent or received until I started getting lovely letters from BCW. Having sent CCA request, can I still go down the Statute bared route, & does anyone have a template letter.0

If that is the case then the debt is almost certainly covered by the Limitation Act, 1980 and will be Statute Barred.
This means that the det is no longer enforceable though the Courts and, once you have infrmed BCW they should cease attempting to 'collect' against it.

HI all,Just a quick update & big thankyou.Having sent a Statute Barred letter to BCW, I have today received a reply stating that, "they can confirm that this account has been closed at this office & returned to their clients".Should I write back asking who there clients, as I am unsure? Do I just sit & wait? Am I going to have more DCA chasing me? Or is that it, is it over.Any help would be gratefully received,Charliebrown0

Do not write back to BCW. Their response letter is 'standard' - basically they are trying to cover their own backs in that they knew that the 'debt' was statute barred before they even started chasing you, but they are most unlikely to admit that as it would expose the underhanded way in which they carry out their 'business'.
I doubt very much that this 'debt' will, in fact, be handed back to 'their client'. It is more than certain that they 'bought' the 'debt' for a few pence in the hope of making a 'killing'. It's a bit like betting a £1 on a 100-1 shot - if it wins, then you have 'hit the jackpot' - if it loses you don't return the betting slip to the bookmaker - you knew the odds, so you bin the slip and hope for better luck on the next race. That's how it works with a BCW - they didn't hit the jackpot with your 'debt', but, given the fact that 99+% of the 'alleged debtors' that they pursue will be totally unaware of the rights that the Limitation Act gives them, and will simply 'pay up' to get these thugs off of their back.
In the unlikely event that you are further pursued for this unenforceable debt, whether u the original creditor or by another dca, then you must report both BCW and any other company chasing you for the same debt to the OFT.I am NOT, nor do I profess to be, a Qualified Debt Adviser.
