Hi, new here can anyone help me.
I am being chased for an outstanding debt by a DCA (BCW), I have sent them a CCA letter, & they have now sent after the 40+2 days a photocopy of what looks like a Credit Agreement. I am unsure though if it is an actual agreement or if it is an application. It is not a very good copy & I canot see any terms & conditions. Can any one help, as I do not know how to proceed with this matter.

The 'true copy of the executed cca' which BCW were legally obliged to have sent you within 12 working days of receipt of your request and £1 Statutory fee must be legible - otherwise it is not enforceable.
It must, also, contain all of the conditions that are listed on the following thread:

You can, if you are able, scan the document (after removing any personal details) and post it here for us to take a look at.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Hi all again, Im having trouble pasting a link, new user & not allowed. Can someone help as I have had another letter from BCW this morning, saying I have not responded, to their last letter & I have not notified them of any legitamate reason for non payment, & I should accept this as Final notice. My CCA letter to them consisted of the following, & all they have sent is the photo copy of alleged CCA.I do not acknowledge ANY debt to your company. I am in receipt of a letter requesting formal demand, for payment of an outstanding balance for £285.61, (copy enclosed). I do not acknowledge this debt to your company and am completely unaware of the account you speak of. I there fore require you to supply the following documentation before I will correspond further on this matter. 1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit) - your obligation also extends to providing a statement of account. I enclose a £1 postal order in payment of the statutory fee, PO Serial Number 000010 08 8002 39842387. This fee is not to be offset against the amount allegedly owing under any circumstances. 2. A signed true copy of the deed of assignment of the above referenced agreement that you allege exists. 3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not under S189 of the CCA 1974. Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities. As you are aware, a credit agreement that is not properly documented and signed by the customer is totally unenforceable under the CCA and therefore is a complete defence to any court claim that is issued. Take note at this stage, that any legal action you may contemplate will be both vigorously defended and contested. Please can anyone help, now starting to get a bit concerned.0
