BT Cancelation charges

Hi! Was wondering if anyone had any advice for me? I have been in a BT contract for 12months and recently received my latest bill that stated i was significantly in credit,with this i contacted BT to arrange a refund and asked if my contract had finished which they told me it had so with this i arranged to move over to sky talk.I called BT again this week as the money had still not been refunded and asked again about the contract, again they said i was no longer in a contract! Today i recived a letter saying i was going to be charged £84.26 for early contract termination! I contacted BT and they said i was in a renewable contract and should have been contacted by letter yet i never received a letter.They have told me they will get the off line department to contact me,but what i want to know is can BT charge me this fee when i've been told twice verbally that i am no longer in a contract and have recieved no lettter to say i would be entered into a new contract? I would appricate any advice,thanks,Di.
