    Anyway back to the point. Thanks for your reply by the way....

    Account was in dispute.... but over the phone.... they said they would try to send the original T&C regarding DD minimum payments....in the meantime husband said he would cancel DD....then agreement was reached to increase new DD whilst this was being looked into. Letter arrived yesterday confirming new DD for card and amount agreed and new date for payment. etc etc. As I said above min payment missed was c.£43 they took £670.

    Reading the post on the forum I dont expect now to get any refund....I am just really p***d off. Barclays did similar to me years ago with a Barclayloan. The didnt take payments for 3 months (banks fault) I didnt notice (my fault) so they took it from wages the day it went in. Loan cleared and it didnt leave me destitute at the time so no real problem then apart from being really p****d off as well. This time different ... due to no income due to economy (self employed) have gone onto housing benefit etc. At the moment only money going into the accounts is child maintenance, tax credits and HB. So not a good time for this to happen. If they had stuck to what they had agreed the day before I wouldnt be posting.

    We were not aware the banks could do this. In future I hope people will take heed not to have credit cards/loans where your income goes.-

    You'd be better going and opening a new account, quick smart! Then get all benefits paid into this account, a Post Office account would suffice unless you need debit cards etc.....

    Thanks for all your advice on this matter. By quoting from the banking code and Martins off setting rules we have successfully managed to have 1/2 paid back by BC and other half by bank. They are also going to refund any charges put on either bank or BC account since the set off. It would seem it pays to complain.
