Existing Claim with Lloyds TSB, What Next?

Hi All,

After a bit of advice if I can. I filed a claim with Lloyds TSB back in 2006, and after much to-ing and fro-ing I made the choice to just hand the claim over to bankchargerecover.co.uk to deal with the claim for me as it was for a large amount (total with interest would be in the region of £15,000 - £16,000) and I didn't have the knowhow or time to run through a long winded legal process. Bad decision I know, but they now appear to have given up on the whole thing, I've not heard a peep from them since 2007 (when the court case kicked off I think) and the legal assignment of the case is now back with me as per their terms (see bottom of their website).

My question is then, Where do I stand now? I sent the template letters to my bank in 2006, they refused (as per normal) and I handed the case over to bankchargerecover (James Cargill) to act on my behalf, I know they contacted Lloyds as Lloyds told me so by letter. Will my claim still be in the 'system' or do I need to file a new claim as the 6 years charges will have changed between then and now. How do I go about claiming if when (as expected/hoped!) the court case rules in favour of the public? Do I need to inform Lloyds they are no longer acting on my behalf and that my claim still stands?

Bit confused about where I go with this. I am very pleased to have ownership of my claim again as I get to keep the 20% they would have creamed off had I won to myself and if the OFT rule that charges are unfair, they have no defence so presumably wouldn't go to court over it? I do not qualify for a hardship claim as I'm getting by with minimal arrears on a few utilities and a car loan. Mortgage is up to date as is my secured loan.

Any advice/information would be very greatfully received

    Have they discharged you from the claim? Have you made them aware that you will not be using them anymore for the claim? Are you aware that they may charge you for dispensing with their services? You need to check with the company first.
