car exhaust problem advice

Hi, I recently posted a thread on the motoring board, but the problem has now turned more 'consumer advice' so I thought I would bring it here.

This is the original thread:

http://forums.moneysavingexpert.com/showthread.html?t=1630949

This helped me to realise that non-genuine 'pattern' parts dont always fit as good as genuine parts, and also convinced my husband to take it back.

He returned to the garage for a second time, the 'manager' agreed it had not been fitted particularly well and had a go refitting it himself.

It's now not catching on the floor when we go over bumps, but it is banging quite hard against the underside of the car, especially when the ignition is turned on, and rattling whenever he is reving/excellerating, it also seems to be 'blowing' more.

My consumer right question is this, we have now been back twice, and have given them plenty of time to correct the problem, (I realise from the other thread that it may never fit as well as a genuine part, but surely we should not have to choose between having it catching the ground, or banging under the car?) Therefore the next step is to ask for a refund.

If I was returning a faulty item I would be able to request a refund (given that repairs have not worked), and hand the item back.

With a car part its more complex, how do we request a refund for an exhaust as it is now part of the car, until we get another one fitted somewhere else, and Im guessing they are not going to refund and happily let us drive off to another garage with the exhaust either!

Anyone had any experience on this?

Thank you.
