i thought the new laws (from Jan 2008?) meant that holiday pay had to be clearly accounted for, so agencies should be quoting a basic rate, with holiday allowance on top, making the 'premum' rate or similar..Long time away from MSE, been dealing real life stuff..

They also did this to me when i temped for them.
When i did my last job for them i asked them to pay me in a lump sum but it took 2 weeks after my last week in job for them to release money and they only released it in whole hours, whereas my allowance was like 45 hours and 30 minutes meaning they still owe me for the half hour they wouldnt pay out. LOL...anything to get your money off you. Worst agency out there for sure!!Thinking it over...:o0 -

Hays did this to me also. I temped with them for 4 months last year before I got my perm role. I was paid £14 p/h but only got £12.70 p/h as they took £1.30 off an hour for holiday pay. When I first took on the role the way they explained it, I thought they would pay me holiday pay, I didnt realise it came out of my hourly rate until I read the contract thoroughly.
I asked Hays not to pay me holiday pay but they refused saying it was law that everyone had holiday pay now?
Although it crippled me at first I made sure I took all my holiday entitlement before the end of the year.
It took me 3 months to get the money owed to me for holiday when I left Hays. I started a perm role on 5th Jan, and got my two days holiday pay out of them on March 29th! Beware!0 -
I was working for hays for over a year getting £9 per hr. Then I left them for a while, then went back and they only got me jobs for £8 an hour then £7 an hour, plus they started taking off holiday pay which meant my last job was £6 an hour. I am now with a different agency who do not take holiday pay.0

They're very clever (dofinately not saying this is right). They're not taking money out of your wages per say - they're telling you your hourly rate is more than it actually is.
My temps get paid a set amount per hour, the holiday pay is a completely seperate entity -it is put into a seperate pot until such a point they take holiday.
FYI - it is against the WTR to pay you your holiday pay unless you are physically not working (i.e taking a holiday) as if they did that, you wouldn't take time off work which would be bad for your health IYSWIM. The only time we can pay holiday pay if you are not taking a holiday is if your contract with us is ended and we have P45'd you.

Given that it will have changed from 1 April (because of the extra WTR holiday entitlement), could you say what the percentage now is for working out holiday entitlement earned by temps.

Hi Littlevoice. The percentage is now 12.07 % of the standard hours worked
i.e if your standard week is 35 hours
35 x 12.07% = 4.22 hours holiday accrued in that week
If you worked 40 hours in that week but your contracted hours are 35, you will still accrue the same hours. This is because holiday pay is not calculated on overtime.

This only took effect from April 01st tho. If you accrued hours prior to that, they were worked out at 10.17%

I also see from the Hays link that their holiday year at the moment is a few days longer than a year and ends on 1 January 2010. So they don't operate on the basis of the anniversary of a temp's first assignment.
Thus everyone needs to be taking their final holiday for the year in the same week - luckily the final day being a bank holiday.
Worth pointing this out (that Hays use a standard holiday year) because not all agencies do that. I know that Select and Brook Street have used the anniversary principle.0 -
