    hi this is what they sent me above today in ther post could 10past6 have a look please this is supposed to be my CCA, should i send the 12+2 letter now. nothing is signed and they sent me a leaflet as well and a letter saying how much intrest they are going to charge me.

    i got this the other month and then thet started asking me for the money stright away again

    debt total on 30/07/12 is £4313.52
    water £847.75, HSBC £479.66, vodafone £262.35, Captial one £415, AA £47.97, scotcall (scottish power) £622, Arrow £420, Welcome £642.41, CSA (scottish power) £484.90, BT £91.50

    When was the agreement taken out?

    It mentions sections 11 & 13. Did they send anything with these sections on it?
    After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91

    hi it was about 5 years ago online they sent a leaflet headed "Important information about your capital One credit card" and it mentions section 11 & 13 as well as a load of other sections


    this is the letter i received
    Thank you for your recent letter requesting copy documents for your account.
    You requested copies of the executed credit agreement and a statement of your account under section 78 of the Consumer Credit Act 1974.

    Please find enclosed a copy of your credit agreement as requested. In accordance with section 78 of the consumer credit act 1974 and the Consumer Credit (cancellation notices and copy documents) regulations 1983, this is your original agreement, and if any terms have been varied, then the copy agreement will include the updated terms. In addition, your personal details, the signature box, signature and date of signature have been omitted from the copy provided as permitted under Regulation 3 of the Consumer Credit (cancellation notices and copy documents) Regulations 1983.

    The status of your account as at date of this letter is currently behind with payments.

    Your current outstanding balance at this date of this letter is xxxxxxxxxx

    The next payment due on your account (including any arrears of overlimit amount) is £xxxxxxxx.This amount needs to reach the account by xxxxxxxxxxxxxxxxxx

    As your account has variable interest rates which may change from time to time I am unable to provide you with a specific schedule of payments detailing the amount due each month in order to pay the current outstanding balance in full. However, the minimum monthly payment will be 3% of the outstanding balance or £5, whichever is greater. Your statements will be produced on xxxxxx of each month (subject to this date not falling on a weekend or a bank holiday) and the minimum monthly payment will be due to the account within 26 days of the statement date.

    I had this same reply from several Creditors. It seems that the 1983 Amendment to the Copy Douments Regs ( and I'm NO expert ) say that if there as been any variatio to the Original Contract ( if there was one ), i.e Interest Rate, Credit Terms etc, then they are able to just send a copt of the current Contract....the one which would be in force now.

    This is NOT what you have asked for, it is what most of the Credit Co send out so that hopefully you will go away and they wont have to bother contacting their Archiving Contractor to search for you Agreement down a tin-mine in Conwall!

    Letter them stating that you requested a copy of the ORIGINAL AGREEMENT and that any failure to do so would be, in the event of future Court Action, represented as a deliberate obstruction on their behalf.
    This worked for me, you get a Copy of the Original with a narky letter but so what!

    If it is the same one (I am struggling with the photo), then 12+ 2 letter.

    hi moneybuster,

    Thats excactly what they sent me, get that 12+2 letter sent off. prepare for the constant phone harrassment tho they are annoying, but just ignore them. they have sent me a reply to the 12+2 letter that basically said we have sent the agreement pay up, let me know if you get that one.
