3rd Year of IVA, now THESIS SERVICING/Link Financial Services Chasing me

I hope I have entered this into the right section as it is my 1st forum posting.

I will try to keep it short. Basically, I entered into an IVA in August 2006 and have kept all payments up to date with no issues. However, last year one of my three student loans (which had been formally agreed by the SLC to form a part of my IVA) was sold onto Thesis. And today I have just received a letter from their Caerphilly office saying they have been trying to contact me about this loan and wanted me to contact them as a matter of urgency as they did not want to make any decisions about my account without getting hold of me first. Well, this is the first I have heard from them, so rang them up straight away. Was put on hold and then eventually transferred to an answering machine and told to leave a message. No-one has got back to me yet.

My concern is that as the SLC has obviously sold-on 1 of the 3 loans, despite being subject to an IVA since 2006 (for which dividends have been paid out each year), but can now Thesis start claiming they did not agree to the IVA, so I will need to pay what is owed, although my income is still below the threshold?

I would like to be pre-armed for when they eventually do ring back, so I know where I stand with this... thanks

Btw I have contacted my IP in the past concerning problems with being chased for payments from creditors despite being subject to an IVA and he is far from helpful... even considered changing IP, but I only have couple more years to go now :rolleyes:

    You need to refer them to your IP, if this debt was included in your IVA then there's nothing they can do about it.

    You have the original IVA documentation which shows that the debt was included within the IVA, they cant touch you.

    I will refer them to my IP, although they still havent got back to me yet, so not sure what is happening. Considering the 'urgency' they refer too in their letter, they do not seem in a hurry to get back to me.

    Write to them with your IP's name and address. There is nothing they can do and if they push it, they are potentially in trouble, not you.
